Abstract

As the interest in the enhancement of waqf contributions increases from day to day and there are various housing projects developed so far through waqf assets and on waqf assets, a retrospective charge of these developments is needed, to crystallise matters of principles and their implication for future projects. The questions to be asked are: whether or not trustee of waqf can build houses on waqf land, whether housing development is in line with Shari’ah principles governing the waqf activities. Is the development of houses for sale in the market in line with the interest of waqf and its beneficiaries? Would this type of project violate the terms and conditions imposed by donors? Do the trustees of waqf have the means to develop and finance such projects? A variety of detailed discussion in order to answer the above questions is needed. This discussion is focused on the past and current records of provision of housing by waqf institutions.
